Rape is a serious crime where the Dutch legal system with address these situations and ensure that both victims and suspects are treated fairly.
Medical and emotional support services are also available for victims to help them recover.
What is rape?
According to the law, rape is defined as, "Rape is any form of sexual penetration, regardless of method, that is performed against the will of a person, whether or not under the influence of force, threat or psychological pressure."
It is important to understand what "against the will" means. This includes:
- Lack of consent: this means that the sexual penetration took place without the victim's free will and consent. This means that the person did not voluntarily consent to the sexual act.
- Physical or mental disabilities: rape can also occur when the victim has physical or mental disabilities that make him or her unable to consciously give consent. For example, this may be the case if a person is unable to express his or her will clearly because of Down syndrome.
- Influenced by alcohol or drugs: if the victim is under the influence of alcohol or drugs and therefore unable to consciously and voluntarily consent to sexual acts.
It is imperative that rape be understood in accordance with these legal definitions to underscore the seriousness of this crime and to ensure the rights of victims.
Punishment rape
According to Article 242 of the Criminal Code in the Netherlands, the maximum prison sentence for rape is currently set at 12 years. This means that a person found guilty of rape can be sentenced to up to 12 years in prison.
- Money penalty: In addition to imprisonment, a fine may also be imposed. The fine for rape falls into the 5th category of fines in Dutch criminal law. This means that the fine can reach a maximum of €90,000, depending on the specific circumstances of the case.
Difference between sexual assault and rape
Sexual assault and rape are both serious crimes, but there are important differences between the two:
Assault:
- Definition: sexual assault involves a person sexually touching, groping or performing other sexual acts on another person without consent and intentionally. It can range from unwanted touching to more severe forms of sexual assault, but no penetration is involved.
- Punishment: penalties for sexual assault can vary depending on the severity of the offense, but they usually include jail time, community service and/or fines.
Rape:
- Definition: Rape is a more serious offense in which a person performs sexual penetration with another person without their consent. This penetration may occur by force, threat, psychological pressure or in cases where the victim is unable to give consent because of, for example, physical or mental impairment, intoxication or drug use.
- Punishment: Rape is severely punished in most legal systems. Punishments often include lengthy prison terms, depending on the severity of the offense and the circumstances.
The main difference between sexual assault and rape is that rape involves sexual penetration without consent, while sexual assault focuses on sexual acts without penetration. Both crimes are serious and are punished seriously, but the nature of the acts differs.
Picket lawyer
In the Netherlands, if the suspect is arrested by the police and placed on remand, a picket lawyer will be assigned. This lawyer will be available on the day of your arrest. However, it is not always guaranteed that this lawyer is specialized in the criminal law, let alone in complex vice cases.
Often, picket shifts are performed by trainee attorneys. Therefore, it is uncertain whether you will receive the proper legal assistance from your assigned picket lawyer in a complex vice case that requires specialized expertise.
